Welcome to CardShark. These Terms of Service ("Terms") govern your access to and use of the CardShark Discord bot, the CardShark Activity at play.cardsharkbot.com, the website at cardsharkbot.com, and any related services (collectively, the "Service"), operated by CardShark ("we," "us," or "our").
By inviting the bot to a Discord server, using its commands, or visiting the website, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use the Service, in line with Discord's own Terms of Service.
The Service runs on top of Discord. Your use of the Service is also subject to Discord's Terms of Service and Community Guidelines. We are not affiliated with, endorsed by, or sponsored by Discord Inc.
Chips in CardShark are play money. They have no cash value, cannot be bought, sold, transferred outside the Service, or redeemed for anything, and we may reset or adjust balances at any time. The Service is not gambling and must not be used to arrange wagers of real money or anything of value.
You are responsible for any activity that occurs through your Discord account or on a Discord server you administer where the bot is installed. Server administrators are responsible for ensuring the bot is used in compliance with Discord's policies and applicable law.
You agree not to:
We may suspend or terminate access to the Service, remove the bot from a server, reset chip balances, or block individual users at our discretion if these Terms are violated.
The CardShark name, logo, website design, and source code are the property of CardShark and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to our trademarks or branding without prior written permission.
We work to keep the Service running reliably, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable from time to time for maintenance, updates, or reasons outside our control (including Discord, hosting, or third-party API outages). We may add, modify, or remove features at any time.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ACCURATE, RELIABLE, OR FREE OF ERRORS.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL CARDSHARK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED USD $20.
You agree to indemnify and hold CardShark harmless from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights, including intellectual property rights.
We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or applicable law. You may stop using the Service at any time by removing the bot from your servers and discontinuing use of the website. Provisions intended to survive termination (including ownership, disclaimers, limitation of liability, and dispute resolution) will continue to apply.
We may update these Terms from time to time. When we do, we will update the "Last updated" date above. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. Material changes may also be announced through the bot, the website, or our Discord community.
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in the Commonwealth of Virginia, and you consent to the personal jurisdiction of those courts.
Questions about these Terms can be sent to support@cardsharkbot.com or asked in our community Discord.
